U.S. EPA Extends TSCA Section 5 Reviews

On February 8, 2019, the U.S. Environmental Protection Agency (EPA or the Agency) published a notice announcing the extension of the review periods for certain Premanufacture Notices (PMNs), Significant New Use Notices (SNUNs), Microbial Commercial Activity Notices (MCANs), and exemption notices submitted to the Agency under Section 5 of the Toxic Substances Control Act (TSCA).  Due to a lack of authorized funding, EPA operations for the TSCA New Chemicals Program were suspended from December 29, 2018 through January 30, 2019.  Because of this suspension, the Agency is extending the review periods for all PMNs, SNUNs, MCANs, and exemption notices ‘received by EPA on or before December 29, 2018 and for which the review period had not expired as of December 29, 2018.’

The duration of these extensions is equivalent to the duration of the suspension, a total of 33 days.  In addition, submissions made through the Agency’s Central Data Exchange (CDX) or other methods were not processed during the suspension.  Therefore, the review period for any TSCA Section 5 notice submitted from December 29, 2018 through January 30, 2019 did not begin until January 31, 2019.

Recommended Action Items

  • Plan accordingly if you submitted any notices affected by this extension; and,
  • Continue to watch this space for information regarding new developments under TSCA.
