U.S. DOT Publishes Notice of Proposed Rulemaking HM-215O

On November 27, 2018, the Office of Pipeline Hazardous Materials Administration (PHMSA) issued a Notice of Proposed Rulemaking (NPRM) HM-215O.

The Notice proposes to amend the Hazardous Materials Regulations (HMR) to harmonize with:

  • The 20th revised edition of the UN Model Regulations
  • The 2019-2020 edition of the International Civil Aviation Organization (ICAO) Technical Instructions
  • Amendment 39-18 to the IMDG (International Maritime Dangerous Goods Code
  • The 7th Revised Edition of the Globally Harmonized System of Classification and Labelling of Chemicals (GHS).

Comments regarding the proposed amendments must be received by January 28, 2019.

What are the proposed amendments?

Some of the new proposed amendments include:

  • Revisions to the Hazardous Materials Table.
  • The addition of a classification system for articles that do not have a proper shipping name.
  • The addition of several new UN numbers and proper shipping names.
  • Inclusion of non-testing alternatives for classifying corrosive materials.
  • Restrictions on the air carriage of smart luggage.
  • Requirements to segregate lithium batteries from certain hazardous materials when transported by aircraft.
  • Updating the HMR list of materials incorporated by reference in 49 CFR 171.
  • PHMSA is proposing to extend the dates for provisions concerning the transport of polymerizing substances from January 2, 2019 to January 2, 2021.

What amendments have the PHMSA proposed not to adopt?

The PHMSA is proposing not to adopt the following amendments from the international standards:

  • Provisions for road gas elements vehicles.
  • Revisions to requirements for fuel gas containment systems.
  • Provisions for the transport of severely damaged lithium batteries.
