Taiwan Amends Guidelines on Regulated Toxic Chemical Substances

On June 28, 2018, the Taiwan Environmental Protection Administration, Executive Yuan (EPA) published an amendment to the Guidelines on Regulated Toxic Chemical Substances and the Management of Their Handling. To prevent the illegal use in the food supply chain and the misuse of food additives, 14 new chemicals (including Sudan dyes) are now designated as Category 4 toxic chemical substances. Additionally, Pentachlorophenyl laurate and Perflurooctanoic acid are added as a Category 1 and 3 toxic chemical substance and a Category 4 toxic chemical substance respectively, due to the recent updates to the Stockholm Convention.

The main changes made by the amendment are summarized below:

  1. Added 14 new dyes as Category 4 toxic chemical substances with the control concentration standard (threshold concentration. A substance is subject to the regulatory requirements with a concentration above that.) of above 1% and promulgated the following additional labelling requirements:
    · The package/container should be clearly marked with the words in traditional Chinese “禁止用於食品及飼料” (“Prohibited for use in foods and feeds”).
    · The label size should not be less than 35% of the main side of the package/container.
    · The color of the letters should be contrasted with that of the background.
  2. Included improvement deadlines regarding packaging, marking, record making, etc. for the 14 toxic chemical substances and Perflurooctanoic acid in Table 4-3 of the Guidelines, and improvement deadlines in related to packaging, marking, record making, transportation, emergency response, etc. for Pentachlorophenyl laurate and Perfluorooctanesulfonic acid in Table 4-2.
  3. Added Pentachlorophenyl laurate as a Category 1 and 3 toxic chemical substance with the control concentration standard of above 0.01%; added Perflurooctanoic acid as a Category 4 toxic chemical substance with the control concentration standard of above 1%.
  4. Changed the control concentration standard for Perfluorooctanesulfonic acid from above 1% to above 0.01%.
