Recent EPA Actions under EPCRA 313

On November 7, 2013, the Environmental Protection Agency (EPA) published a final rule to add o-Nitrotoluene, CAS Registry Number (CAS RN) 88-72-2, to the list of toxic chemicals subject to reporting under Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA) of 1986 and Section 6607 of the Pollution Prevention Act (PPA) of 1990.  This final rule shall apply for the reporting year beginning January 1, 2014, for which reports are due July 1, 2015.

In a separate but related action, EPA published a notice on December 9, 2013 to announce its denial of a petition to remove Chlorsulfuron, CAS RN 64902-72-3, from the EPCRA Section 313/PPA Section 6607 list.  According to the Agency, its denial of the petition is based upon its conclusion that Chlorsulfuron meets the environmental effects criterion of EPCRA Section 313(d)(2)(C) due to its toxicity to aquatic plants.  Thus, this substance continues to be subject to reporting.
